Which States Actually Require Severance Pay
Severance pay feels like it should be a guaranteed right. In nearly every state, it is not. Here is where the exceptions apply.
It is a common assumption that severance pay is a legal right after losing a job. For the large majority of private-sector workers in the United States, that assumption is incorrect.
The general rule
In 48 states, there is no general legal requirement for an employer to offer severance pay at all. Severance in most of the country is a matter of company policy, employment contract terms, or negotiation, not a baseline legal entitlement.
The exceptions
New Jersey stands out as the clearest exception. Its state WARN Act requires actual severance pay for covered mass layoffs, generally calculated as one week of pay per year of service. Maine has a narrower requirement that applies specifically to mass layoffs affecting 100 or more workers.
When severance becomes legally required regardless of state
Even outside these specific state laws, severance can become a legal obligation in certain circumstances nationwide. If an employer has a written policy promising severance, that policy can become a binding commitment. If severance is included in a collective bargaining agreement, it is enforceable under that contract. And if an employer fails to provide the notice required under the federal WARN Act before a mass layoff, back pay covering that notice period is often owed as a result.
What this means if you are laid off
Do not assume severance is guaranteed simply because you have heard it discussed as though it were standard. Check whether your employer has a written severance policy, whether you are covered by a relevant collective bargaining agreement, and whether the layoff met the threshold for WARN Act notice requirements.
